Shortly thereafter, this small-statured 72-year-old - the central figure at the heart of the biggest criminal proceedings in France's judicial records, featuring 51 men including her partner - had emerged as a symbol of resilience.

She was last seen in the public eye when the verdicts - every defendant found culpable - were announced in the final month of 2024. At that point, crowds of supporters were calling out her identity.

On Monday Gisèle Pelicot returns to the judicial process, this time in Nîmes, for the appeal of the lone defendant of the multiple perpetrators to contest his punishment: Husamettin Dogan, 44, a married father of a single child.

The Case That Transformed French Society

During the autumn months the previous year, the survivor's disturbing story travelled the world. For over ten years, she had been sedated unconscious by her husband Dominique and assaulted by numerous men he had recruited on internet chat rooms.

The husband recorded the assaults and meticulously documented them on a digital drive, which permitted authorities to locate the greater part of the suspects participating. Around 20 could not be recognized and continue to be at large.

Subsequent to a legal proceedings continuing for multiple weeks, forty-six individuals were convicted of violation, two individuals of attempted sexual assault and another two of assault. Dominique Pelicot was given the maximum prison term of multiple years.

The Legal Challenge Process

Husamettin Dogan's legal challenge in the coming days will, in effect, be a fresh hearing. The videos of the victim's assault will be displayed in the courtroom anew, and the husband will be there – now, nevertheless, only as a testifier.

While she is not required to, the survivor as well will be present at the proceedings.

"All people would have understood if she hadn't come as, well, she is trying to return to a ordinary routine," a member of her attorneys, the attorney, stated. "However she believes she needs to be in attendance and has a obligation to be present up to the end of the judicial matters."

Courtroom Tactics

As was the case for several of the other 51 men, the defendant's legal argument depended on the contention he could not be guilty of assaulting Gisèle because he had failed to recognize she would be in a drugged state. The perpetrator rejected this argument, saying he had explicitly stated to the participants he recruited through digital means that his partner would be medicated.

In his statement the previous year the appellant acknowledged informing the husband that his wife "appeared lifeless". Still, he forcefully objected regarding the charges directed at him. "I cannot accept being categorized a sexual predator," he objected. "It's too heavy a burden for me to carry."

Even though 16 other defendants also originally lodged appeals, Dogan was the lone person who has continued with it.

Personal Division

During the legal process began in last year, she was supported by her three grown offspring – the eldest daughter, her son and the younger son. Now, the tight-knit family unit that walked into the courthouse previously is has dissolved.
